Attorney/Partner, Lacy Katzen LLP

Years in current role: 2014 as Partner; Chair of the Elder Law Department since 2018

What changes in the legal industry do you believe will have the biggest impact on clients over the next few years?

As an elder law attorney, I am concerned about the possible increase in Medicaid reimbursement rates to nursing home facilities. On one hand, the increase of these rates should meaningfully impact the care and services provided for those most vulnerable. Conversely, the higher rates could increase the number and dollar amount of lawsuits against spouses of those institutionalized when engaged in certain types of asset-protection planning. The issue is not simply whether reimbursement rates should increase, but whether a balance can be reached to adequately fund facilities while simultaneously protecting assets for elderly couples.

What is one challenge currently facing the legal profession that deserves more attention?

I am concerned about the possible use of AI in the legal profession by non-lawyers in answering complaints and/or filing frivolous lawsuits, using fictious or inappropriate cases for self-serving retaliation purposes, and burdening our judicial system.

How do you balance legal expertise with client service and relationship-building?

Competency is a client-relationship builder. Providing legal remedies available to each client and patiently discussing in detail the pros and cons of each option builds client trust which in turn builds a quality and lasting relationship. Treating clients how you would want to be treated as a client is key.

What is one accomplishment — professional or personal — that you are especially proud of?

Flying a 1965 Cessna to Pennsylvania to have dinner was a wonderful and rewarding experience. Sticking the landing and maintaining altitude and heading over mountains while hand flying (meaning no auto pilot) was one of the most liberating and accomplished feelings I ever had. It almost was better than passing the bar exam.
