Local contractor Ferguson-Hall Co. Inc. faces a $70,000 federal fine related to an accident in which a 21-year old construction worker died at the University of Rochester last year.
“This accident should never have happened,” said Art Dube, area director for the U.S. Department of Labor’s Occupational Health and Safety Administration, in a press statement. “The employer knew that this excavation should have been protected against collapse.”
Ferguson-Hall now has 15 days to request an informal hearing with the OSHA area director, or to contest the fine through an OSHA commission.
In a project to construct new water lines on UR’s River Campus, a worker entered a trench eight and a half feet deep. The bank of the trench fell in and killed him.
OSHA standards require excavations more than five feet deep be protected by sloping the soil, shoring up the sides or using a protective trench box.
None of the protections were used to prevent the accident, OSHA officials said. The agency termed the incident “a willful violation of safety standards.”
