U.S. District Court Judge David Larimer started it by quoting Shakespeare’s King Henry VI in an early decision in the antitrust fight between Rochester Gas and Electric Corp. and Kamine/Besicorp Allegany LP.
Both the utility and the independent power producer got in on the action.
Kamine’s briefs cited Sir Walter Scott’s Lay of the Last Minstrel–something about weaving tangled webs–in attacking RG&E’s position.
But when RG&E recited Humpty Dumpty in its legal papers, Larimer issued a warning.
It was not that the judge had anything against the nursery rhyme, Larimer told RG&E lawyer John Smith in arguments Wednesday.
In fact, he had used it himself in an opinion. An opinion that was dumped on appeal.
